Democrats Try To Game Elections By Changing Prop 39 Ballot Title, Censor Ballot Argument:

Proponents Take Two Lawsuits To Superior Court To Stop Distortions

By Michael Hernandez (Aug. 5, 2026)

SACRAMENTO–“California Democrats are trying to rig the election against our Prop 39 Voter ID Initiative,” said Carl DeMaio, chairman of Reform California and California Assemblyman (R-75, East San Diego County). “There is a crucial legal hearing this Thursday in Superior Court on two key lawsuits as we fight to stop them.”

Court Case #1: Dishonest Rigging Of Prop 39 Ballot Title

“The first case the judge will hear is our lawsuit against Attorney General Rob Bonta for his corrupt attempt to change the Prop 39 ballot title at the last minute. The new ballot title on Prop 39 falsely claims it “Prohibits Citizens from Voting...Unless we win this lawsuit, voters will see a biased and false ballot title on Prop 39 that manipulates them into voting NO on Voter ID!

ORIGINAL FAIR PROP 39 TITLE (September 19, 2025):
ESTABLISHES ADDITIONAL VOTER IDENTIFICATION AND CITIZENSHIP VERIFICATION REQUIREMENTS.
Initiative Constitutional Amendment. This measure would amend the California Constitution to further require that voters present government-issued identification at the polls or the last four digits of a government-issued identification number when voting by mail; the State provide voter identification cards on request; and elections officials annually report percentage of each county’s voters whose citizenship they have verified.

REVISED DISHONEST PROP 39 TITLE (July 21, 2026):
PROHIBITS CITIZENS FROM VOTING UNLESS THEY PRESENT GOVERNMENT-ISSUED IDENTIFICATION.
Initiative Constitutional Amendment. Invalidates mail ballots that do not have last four digits of designated government-issued identification number written on envelope. Prohibits in-person voting without presenting government-issued identification.

Court Case #2 – Democrats Want To Censor Our Prop 39 Ballot Argument

“The second case the judge will hear is the outrageous lawsuit filed by Democrat politicians late last week that seeks to prevent our Prop 39 campaign from making the arguments we want in the ballot book. Under election law, we as the Prop 39 proponents are allowed 500 words to describe and argue in favor of our initiative.

“After rigging the ballot title on Prop 39, with this frivolous lawsuit CA Democrats are trying to strip us of our rights to argue in favor of Prop 39! If we lose this lawsuit, CA Democrats will get to rewrite the YES on Prop 39 argument – and you know damn well they won’t give it a favorable description.”

What the California Voter ID Initiative (Prop 39) does? Here’s what Prop 39 requires:

1. Photo ID To Vote

Voters would provide a government issued ID for in-person voting or provide last four digits  of a government ID for voting by mail.

2. Verification Of Citizenship

Election officials would be required to verify that only eligible individuals are registered to vote and receive ballots. Citizenship must be verified.
